Intellectual Property

As a result of its long collaboration with the Government and Supreme Court of India, ISDLS has recently been invited to initiate an intellectual property reform program in India. This program began in January 2005 with an IP seminar in New Delhi. District Court Judge Jeremy Fogel (Northern District of California), Chief of the DOJ’s Computer Hacking and Intellectual Property Unit Christopher Sonderby (San Jose/Silicon Valley), Indian Business Software Alliance counsel Pravin Anand, and Indian Motion Picture Association counsel Chander Lall gave presentations on the imperative of IP enforcement and mechanisms by which this enforcement can be achieved.

Though the GOI has enacted adequate legislation to prosecute and punish offenders, backlog in courts has prevented prosecutors from pursuing cases and/or judges from issuing sentences severe enough to deter criminals. The civil justice reform mechanisms introduced as result of ISDLS’ ongoing civil justice initiative will reduce backlog, paving the way for IP enforcement.

The seminar, attended by approximately fifty judge, prosecutors and professionals, generated optimism about the future of IP in India. Mr. Anand and Mr. Lall expressed a strong commitment to further pursue the creation of an Indian prosecutorial unit modeled on that of CHIP with the Government of India.
