China - Civil and Criminal


ISDLS has been working with the Chinese judiciary since 1985, when an ISDLS delegation to China conducted a mock trial demonstration to increase understanding of the American judicial system.

In collaboration with members of the US Supreme Court, ISDLS is conducting a civil and criminal justice study exchange with the Shanghai High People's Court. This study will examine the effectiveness of trial alternatives in reducing backlog and delay, and will focus on the wide variety of civil and criminal Alternative Dispute Resolution (ADR) mechanisms employed throughout the state of California. In April 2003, a judicial delegation from the Shanghai High People's Court will work in Washington, DC and California to observe and discuss issues and processes of legal modernization.

The group, in affiliation with an American law school, will construct a long-term study program based on the findings of the April delegation. This program will consist of judicial residencies lasting approximately eight months each, providing the opportunity for members of the Chinese judiciary to conduct a detailed and thorough examination of the US justice system. The curriculum will focus on the development, procedures and affects of civil and criminal ADR processes in all types of courts and legal procedures.
